New Delhi: The Supreme Court has granted an interim stay on the Karnataka High Court order that had declared the election of Bagepalli MLA N. S. Subbareddy invalid.
The apex court has given six weeks’ time to the respondent, the Election Commission, and other concerned parties to file affidavits and counter-affidavits. The matter has been posted for further hearing on September 7.
Subbareddy, a Congress legislator representing Bagepalli (Bhagyanagar) Assembly constituency in Chikkaballapur district, had approached the Supreme Court challenging the High Court verdict that disqualified him from holding office.
The appeal was heard by a Bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi.
The High Court had earlier set aside Subbareddy’s election after concluding that there were violations in the disclosure of assets and alleged non-disclosure of pending criminal cases in his nomination affidavit. The petition challenging his election had been filed on June 24, 2023, by BJP’s defeated candidate Muniraju.
With the Supreme Court staying the High Court order, Subbareddy will continue as MLA of Bagepalli until the next date of hearing. Notices have been issued to the respondents, and the matter will now be adjudicated further by the apex court.
